What is Legal Malpractice?
Lawyers are obligated to comply with a code of ethics embodied in the Ohio Rules of Professional Conduct. It addresses a lawyer’s conduct in various situtation. When dealing with a client, a lawyer has a fiduciary duty to act with honesty, good faith, fairness, integrity, and fidelity. A lawyer should never take any action that is imporoper under the rules or any action that would even suggest the appearence of impropriety.
Even after a lawyer and their client terminate their relationship, a lawyer in to allowed to acquire an interest that is adverse to a client, or represent an individual or business that has an adverse interest to a client.
In legal-ese, a “fiduciary” is someone that takes on the trust of another person to act on their behalf. When you hire an attorney they take on this fiduciary duty to not only represent you competently and professionally, but to put your interests first. The attorney-client relationship is one of the most sacred and protected under the law.
Do I have a claim for Malpractice?
A claim for malpractice can arise when an attorney you hired has acted negligently or intentionally and you have been harmed. This can happen when a lawyer fails to submit a court filing before a deadline or provides improper legal advice. The most egregious examples often occur when an attorney ignores a conflict of interest.
Conflicts of interest arise when an attorney attempts to represent both sides of a transaction or represents someone suing their former client. A lawyer should never put themselves in this position, whether it’s at the negotiating table or in the courtroom.
